Q. Can a company demote or fire you because you do not have a college degree? My husband's company, who he has worked for over 5 years, is telling him that his job is going to be eliminated because they don't think he will be able to do the job. They have never had any complaints regarding his job performance and now since he has a new boss, his new boss told him that he would rather have a degreed person in his position. Does my husband have any rights? A. I recommend that you and your husband contact the Equal Employment Opportunity Commission or an employment or labor attorney, as this is a legal matter. We are not attorneys; and as such are unable to advise you of your legal rights. I believe it depends on where you live as to the reasons a company can fire you. Some states, such as Texas, are right to work states and a company can terminate employees at will. However, there may be still some litigation risks associated with any termination as shaky as you describe above.If your husband suspects a demotion or termination is in the wind, it would be a good idea for him to polish his resume and begin networking and seeking other opportunities, so he can find a position where he will still be able to make a contribution and those contributions will be appreciated, valued, and rewarded.
